La presente investigación tiene el objetivo de analizar la vulneración del debido proceso ante los derechos humanos y, así mismo, la aplicación dentro de los procedimientos judiciales. Para el desarrollo de la investigación se realiza una metodología descriptiva con el fin de obtener la información sobre la vulneración del derecho, la formulación de cargos y los principales factores que se generan en la unidad judicial, además del análisis del derecho procesal y cuestiones de indagación previa. Los resultados indican que existen una mala práctica cuando surgen casos urgentes y se genera la orden de detención, donde uno de los principales aspectos es que en 24 horas se realizan varios procesos, como en ciertos puntos, la toma de versiones para la audiencia de formulación de cargos. De acuerdo a estos resultados, la mala práctica sobre la vulneración del derecho se hace muy evidente, generando una afectación directa con la persona que está siendo procesada
