Insufficient regulation of the digital evidence and its assessment in the criminal process

Abstract
Digital evidence within a criminal process implies a different assessment than the traditional one, which is why within the present investigation we have analyzed how digital evidence should be treated, analyzed, transferred and safeguarded, capturing all of this in a single chapter within the criminal regulations, in which the correct procedure for the due assessment of digital evidence is indicated and in which cases it will not have procedural validity because it has not been obtained legally and properly, or it has been altered through digital manipulation, all of this under strict adherence to the guarantee of fundamental rights stipulated in the Constitution of the Republic of Ecuador. Digital evidence must follow parameters to be considered within a criminal process, from its chain of custody to the treatment given to it so that it is presented at the appropriate procedural time.
