Abstract

When the Ecuadorian state approved Decree No. 755, regulation to the organic law that regulates the legitimate use of force on June 2, 2003, it recognized the protection of the exercise of their functions to police and military officers through an organic law, granting faculties of obligatory compliance. The need to create a decree by means of an organic law is to establish order in an efficient and controllable administration within the Ecuadorian National territory. Being objective of study and reflexive regarding the progressive use of force and its legitimate defense within the mentioned state, taking into account the fundamental and constitutional rights of the citizens. The analysis of the present study considers the respect towards human rights, as well as the total ignorance of the citizens and professionals about the police and military actions in the national territory when facing their right to life in situations of extreme necessity.
