The principle of proportionality in administrative sanctions in the Ecuadorian legal system

Abstract

The principle of proportionality in administrative sanctions in the Ecuadorian legal system constitutes an issue of vital importance, since its proper application is essential to guarantee equity and justice in the sanctioning system. The lack of uniformity in its application between different administrative entities creates situations of inequity, undermining the coherence of the system and undermining citizens' confidence in administrative justice. Furthermore, the regulatory ambiguity in the definition of proportionality criteria generates subjective interpretations, leading to arbitrary decisions and affecting legal certainty. The absence of effective mechanisms for review and control of administrative decisions regarding sanctions represents another challenge, compromising the protection of individual rights. Therefore, it is crucial to address this problem to establish clear procedures that allow citizens to challenge sanctions considered unfair, ensuring an impartial and transparent review. In summary, the review and improvement of the principle of proportionality in administrative sanctions in Ecuador is presented as a prevailing need to strengthen legality, equity and confidence in the sanctioning system, thus preserving the fundamental rights of citizens.

Public Official, currently carrying out work activities in the Ministry of Education as an Analyst in the National Sponsorship Directorate since 2017. 

 

Likewise, he worked for other State institutions, such as the Municipality of the Metropolitan District of Quito, and the Property Registry.
