The mandatory nature of the Covid-19 vaccine in Ecuador: A legal and medical approach

Abstract
The main purpose of this study was to examine in depth the obligatory nature of the COVID-19 vaccine in the Ecuadorian scenario, focusing particularly on the tension present between the so-called individual and collective rights arising from this governmental health action. For these purposes, we indicate that the specific objectives of this study included: recognizing health strategies and the legislative reforms implemented; examining Constitutional Court Ruling No. 127-21-IN; and analyzing the academic literature on the normative problem we have previously discussed. However, we indicate that the approach used was of a qualitative nature that was based on the existing normative, jurisprudential and doctrinal review regarding the topic proposed in this research, so that from the considerations mentioned we determined that the vaccination action proposed by the government of Ecuador is constitutional, given that in situations of health emergencies, the general interest may prevail over the personal rights that make up the state citizen social conglomerate.
