Analysis of prison overcrowding in Ecuador during the period 2021-2023

Abstract
Prison overcrowding refers to the situation in which jails or prisons exceed the inmate population for their designed capacity. This problem is common in several prison systems worldwide and implies negative consequences for the human rights of people deprived of liberty, prison staff and the State.
In Ecuador, prison overcrowding has persisted for years. However, speaking of the period 2021-2023, the Penitentiary System experienced and still maintains a serious structural and functional crisis. The increase in prisoners brings serious concerns to Ecuadorian society, regardless of whether or not they are family members of the detainees, as well as concerns to the State; It has been seen through digital media that the prisoners themselves govern the prisons in the face of state inefficiency, a situation that brings with it: riots, corruption, deteriorated infrastructure and the list of prison problems goes on.
It is necessary that new public politics work on prevention to address this problem, since it is useless to toughen penalties and continue filling prisons if the systemic and structural causes of violence are not eliminated, which, yes, is a complex challenge, but it is important to face it to protect the human rights of prisoners, avoid costs to the State and guarantee the security of society.
