The criminal liability of digital platforms in the protection of intellectual property rights

Abstract

Digital platforms are a common space for sharing ideas, work, and products, and intellectual property rights are the main concern. This study focused particularly on Ecuador, and especially in the Durán canton. Legal loopholes prevent real and effective protection against unauthorized use in the digital environment. Legal analysis, research, and reviews demonstrated that students and the general population are limited by criminal legislation, as the current legislative system clearly fails to determine the liability of these platforms, leaving creators vulnerable to plagiarism or unnecessary attribution. This work not only identified problems but also initiated legal reforms and digital education strategies, taking into account the urgent need to strengthen the legal culture of intellectual property. The findings show that a combination of updated laws, country-specific actions, and greater citizen understanding is needed to truly protect Ecuador's creators.

I am a lawyer with over 20 years of experience in criminal law and criminal procedure. I work independently and am currently pursuing a master's degree at the Bolivarian University of Ecuador.

As a lawyer specializing in criminal law, throughout my successful career, I have participated in numerous criminal hearings and trials, both as a defense attorney, plaintiff, and civil plaintiff.
