Challenges in Local Governance in Ecuador for Implementing Public Policies and Ensuring Human Rights

Abstract

The present study aims to analyze the challenges faced by local governance in Ecuador in implementing effective public policies that ensure human rights. A qualitative research methodology will be employed, utilizing systemic, inductive, and deductive methods, as well as exegetical and historical approaches. Among the data collection techniques, a documentary compilation of legal and doctrinal sources will be conducted. Although the Ecuadorian Constitution establishes principles of decentralization and fundamental rights, limited inter-institutional coordination, scarcity of resources, and the lack of effective mechanisms for citizen participation hinder the implementation of inclusive and sustainable public policies. Through this study, we seek to identify the main factors affecting local governance and propose strategies to strengthen the capacity of decentralized autonomous governments to guarantee rights within their communities.

A lawyer with experience in various public institutions, including the Gobernación de Pastaza in the planning area, the GAD Provincial de Napo as an analyst, and the National Electoral Council (CNE) as a territorial trainer. She currently works as a legal advisor at DINEMAS. Throughout her career, she has made significant contributions in the legal field, especially in research, with a particular focus on constitutional, administrative, and electoral law. Her work has centered on improving institutional processes.

A legal professional and litigator, he holds a Master's degree in Criminal Law, Criminal Procedure, and Oral Litigation, and a Master's degree in Contemporary Constitutionalism and Local Governance. He has held public office, including District Director of the Ministry of Education (MIES), currently involved in the process of human v rights violations in the Amazon
