The Independence of Forensic Bodies in Ecuador as a Guarantee of Constitucional and Legal Values

Abstract

This article identifies the harmfull potential that a forensic medical examination or any other participation of expert witnesses may contain when said participation does not meet certain requirements, or is not carried out within the framework of the constitutional values ​​of effective judicial protection and due criminal process. The importance of delving into the tensions generated by expertise or expert judgment lies in the potential to forever alter the procedural truth and the lives of citizens in conflict with criminal law. For this reason, the problem is identified with the purpose of providing theoretical solutions in this academic field.


It is in this sense that in the present issues little discussed, but of transcendental importance in the current discussion, will be addressed, since they generate tensions between constitutional values ​​and the product of expertise itself, such as prejudices and predispositions. of the investigating agents subject to the jurisdictional procedure, the influence and effects of the directing entity on the expert. In the same way, external factors that contribute to the current panorama in which the discussion takes place will be analyzed. While at the same time issues such as: the independence of the expert entity, the privatization of investigative systems and others intrinsically related to the title that is presented to the reader are addressed.
