Democratic rights in Ecuador: analysis of Judgment No. 140-18-SEP-CC of the Constitutional Court of Ecuador

Abstract
The following paper analyzes the case No. 1764-17-EP and its Judgment No. 140-18.SEP-CC dated April 18, 2018, issued by the Constitutional Court of Ecuador, on the violation of the democratic rights of the PhD. Cesar Eduardo Montaño Galarza, to be elected, since the Council of Higher Education of Ecuador in conjunction with the Andean Parliament, determined that his tenure as Rector at the Simón Bolívar Andean University does not correspond to an electoral process. From this case it is possible to relate the democratic rights related to the republic as a form of government, the right to be elected as an expression of autonomy and sovereignty and the judicial role of the public body on democratic rights in Ecuador, through this case It will facilitate the understanding of the right to be elected as a fundamental right and how this represents a foundation in the institutionalization of the republic. The objective of this work is to analyze in a timely manner the Sentence No. 140-18.SEP-CC, on the violation of the democratic rights of the PhD. Cesar Eduardo Montaño Galarza, in relation to the right to be elected.
