Abstract
The present research work aims to analyze the protection action in Ecuadorian legislation, to show if there is job insecurity within the contracts of occasional services and the effectiveness of this action when it is presented by the violation of constitutional rights within these contracts that occur under the regime of the Organic Law of Public Service. For which the deductive-inductive methodology was used, starting from the general to the particular, to understand the definitions of the issue raised, being so, the present investigation resulted in the origin of the protection action to be the appropriate and effective way in the case of occasional service contracts that have been distorted by public sector institutions, which have caused the impairment of the constitutional rights of the acting and therefore that has been a victim of job insecurity during the duration of the employment relationship he maintained with the institution in which he worked.
